OBAMA signs renewal of Foreign Surveillance Law

Isn’t he a peach!  The most transparent administration has gone black to avoid the limelight of his (and Congress’ s) traitorous actions.  Not to mention they reauthorized the National Defense Authorization Act (NDAA), without any partisan complications.

OBAMA SIGNS RENEWAL OF FOREIGN SURVEILLANCE LAW

WASHINGTON (AP) -- President Barack Obama has signed into law a five-year extension of the U.S. government's authority to monitor the overseas activity of suspected foreign spies and terrorists.

The warrantless intercept program would have expired at the end of 2012 without the president's approval. The renewal bill won final passage in the Senate on Friday.

Known as the Foreign Intelligence Surveillance Act, the law allows the government to monitor overseas phone calls and emails without obtaining a court order for each intercept.

The law does not apply to Americans. When Americans are targeted for surveillance, the government must get a warrant from a special 11-judge court of U.S. district judges appointed by the Supreme Court. Click here to read the full story.


NDAA Indefinite Detention Bill Passes Senate After Rand Paul Calls It An 'Abomination'

The Senate passed a version of the National Defense Authorization Act that was stripped of a prohibition of the indefinite military detention of US citizens on American soil by an 81-14 vote on Friday, but only after a furious dissent on the chamber's floor by Sen. Rand Paul (R-Ky.), who called it an "abomination."

The National Defense Authorization Act of 2013 will now head to the White House, which had earlier pledged to veto the NDAA because it prevents the president from closing the Guantanamo Bay detention camp. It is unclear whether the president will follow through on the threat.  Click here to read the full story.

Your Free Speech Has Been Abridged!

Last Thursday (March 9, 2012), the President signed a bi-partisan bill HR347, giving the federal government the ability to make it a felony to violate “No-Free Speech Zones”.  This bill will allow them to make “No-Free Speech Zones”!  Has this occurred because Washington D.C. is expecting a lot of push back in 2012 for the actions that they have taken to disregard their pledge to protect and defend the Constitution by the vocal Tea Party groups, who protested peacefully and left the protest areas cleaner than they found it?  Or, is it because they fear the public display’s coming from the “Occupiers”?  The President and many of the members of the House and Senate, publicly supported the Occupiers demands?  Why would they try to shut us out?

If you have an opinion, I would be happy to post it here, but please contact your local representatives and local media to spread word on how they have silently abridged your 1st Amendment rights!

“Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.”

Time to contact your federal/state/local representatives to express your opinions on this unfortunate, anti-Constitutional bill.

Let Congress Know How “You” Want to be Represented

Speaker Boehner is asking to hear from you on the Keystone Pipeline proposal.

The Keystone Pipeline endeavor has been in the works for three years, has passed approval of the EPA,is solely funded by private capital, but is being prevented from passage by the Obama Administration’s failure to act on it.  The Obama Administration has the opportunity to give a “thumbs up” yes, or a “thumbs down” no.  The fact is that Obama wants this to be a plus for his 2012 campaign by appearing to be against the project now, but soon after his election he is expected to approve the project to reward the labor vote.

The United States needs reliable energy sources now, reliable jobs now, without being a puppet to the politicians and their elections.

Let Congress, Senate and the Obama Administration know how you feel.  Is a Social Security temporary tax reduction of $40.00 per week (which further risks that Social Security will become insolvent, sooner) a positive thing for government to be concerned with?  Or, should our elected representatives get out of the way of a private venture that will bring energy, jobs and much needed tax revenue to states and federal coffers?

MF Global is just one more example of the corruption and cronyism that has overtaken the Country.  You need to fully understand the implications that have arisen since the announcement of MF Global’s bankruptcy, the missing “billions” of dollars and how the current Obama Administration is handling this failure.

The Obama Administration “is” corrupting the rule of law and thus they are destroying the Country by their flagrant abuse of the law.  Since the United States Congress has not taken action to impeach this administration (and I no longer believe the Country will survive to the 2012 elections), it’s time for the People to start pressuring Congress to do so.  I have no faith in his Administration and will be contacting any and all Representatives in Washington D.C. to start this action.Sus Devp (small)

It is with regret and unflinching moral certainty that I announce that Barnhardt Capital Management has ceased operations. After six years of operating as an independent introducing brokerage, and eight years of employment as a broker before that, I found myself, this morning, for the first time since I was 20 years old, watching the futures and options markets open not as a participant, but as a mere spectator.

The reason for my decision to pull the plug was excruciatingly simple: I could no longer tell my clients that their monies and positions were safe in the futures and options markets – because they are not. And this goes not just for my clients, but for every futures and options account in the United States.The entire system has been utterly destroyed by the MF Global collapse. Given this sad reality, I could not in good conscience take one more step as a commodity broker, soliciting trades that I knew were unsafe or holding funds that I knew to be in jeopardy.

The futures markets are very highly leveraged and thus require an exceptionally firm base upon which to function. That base was the sacrosanct segregation of customer funds from clearing firm capital, with additional emergency financial backing provided by the exchanges themselves. Up until a few weeks ago, that base existed, and had worked flawlessly. Firms came and went, with some imploding in spectacular fashion. Whenever a firm failure happened, the customer funds were intact and the exchanges would step in to backstop everything and keep customers 100% liquid – even as their clearing firm collapsed and was quickly replaced by another firm within the system.

Everything changed just a few short weeks ago. A firm, led by a crony of the Obama regime, stole all of the non-margined cash held by customers of his firm.Let’s not sugar-coat this or make this crime seem “complex” and “abstract” by drowning ourselves in six-dollar words and uber-technical jargon. Jon Corzine STOLE the customer cash at MF Global. Knowing Jon Corzine, and knowing the abject lawlessness and contempt for humanity of the Marxist Obama regime and its cronies, this is not really a surprise. What was a surprise was the reaction of the exchanges and regulators. Their reaction has been to take a bad situation and make it orders of magnitude worse. Specifically, they froze customers out of their accounts WHILE THE MARKETS CONTINUED TO TRADE, refusing to even allow them to liquidate. This is unfathomable. The risk exposure precedent that has been set is completely intolerable and has destroyed the entire industry paradigm. No informed person can continue to engage these markets, and no moral person can continue to broker or facilitate customer engagement in what is now a massive game of Russian Roulette.

I have learned over the last week that MF Global is almost certainly the mere tip of the iceberg. There is massive industry-wide exposure to European sovereign junk debt. While other firms may not be as heavily leveraged as Corzine had MFG leveraged, and it is now thought that MFG’s leverage may have been in excess of 100:1, they are still suicidally leveraged and will likely stand massive, unmeet able collateral calls in the coming days and weeks as Europe inevitably collapses. I now suspect that the reason the Chicago Mercantile Exchange did not immediately step in to backstop the MFG implosion was because they knew and know that if they backstopped MFG, they would then be expected to backstop all of the other firms in the system when the failures began to cascade – and there simply isn’t that much money in the entire system.In short, the problem is a SYSTEMIC problem, not merely isolated to one firm.

Perhaps the most ominous dynamic that I have yet heard of in regards to this mess is that of the risk of potential CLAWBACK actions. For those who do not know, “Clawback” is the process by which a bankruptcy trustee is legally permitted to re-seize assets that left a bankrupt entity in the time period immediately preceding the entity’s collapse. So, using the MF Global customers as an example, any funds that were withdrawn from MFG accounts in the run-up to the collapse, either because of suspicions the customer may have had about MFG from, say, watching the company’s bond yields rise sharply, or from purely organic day-to-day withdrawals, the bankruptcy trustee COULD initiate action to “Clawback” those funds. As a hedge broker, this makes my blood run cold.Generally, as the markets move in favor of a hedge position and equity builds in a client’s account, that excess equity is sent back to the customer who then uses that equity to offset cash market transactions OR to pay down a revolving line of credit. Even the possibility that a customer could be penalized and additionally raped AGAIN via a clawback action after already having their customer funds stolen is simply villainous. While there has been no open indication of clawback actions being initiated by the MF Global trustee, I have been told that it is a possibility.

And so, to the very unpleasant crux of the matter. The futures and options markets are no longer viable. It is my recommendation that ALL customers withdraw from all of the markets as soon as possible so that they have the best chance of protecting themselves and their equity. The system is no longer functioning with integrity and is suicidally risk-laden. The rule of law is non-existent, instead replaced with godless, criminal political cronyism.

Remember, derivatives contracts are NOT NECESSARY in the commodities markets. The cash commodity itself is the underlying reality and is not dependent on the futures or options markets. Many people seem to have gotten that backwards over the past decades. From Abel the animal husbandman up until the year 1964, there were no cattle futures contracts at all, and no options contracts until 1984, and yet the cash cattle markets got along just fine.

Finally, I will not, under any circumstance, consider reforming and re-opening Barnhardt Capital Management, or any other iteration of a brokerage business, until Barack Obama has been removed from office AND the government of the United States has been sufficiently reformed and repopulated so as to engender my total and complete confidence in the government, its adherence to and enforcement of the rule of law, and in its competent and just regulatory oversight of any commodities markets that may reform. So long as the government remains criminal, it would serve no purpose whatsoever to attempt to rebuild the futures industry or my firm, because in a lawless environment, the same thievery and fraud would simply happen again, and the criminals would go unpunished, sheltered by the criminal oligarchy.

To my clients, who literally TO THE MAN agreed with my assessment of the situation,and were relieved to be exiting the markets, and many whom I now suspect stayed in the markets as long as they did only out of personal loyalty to me, I can only say thank you for the honor and pleasure of serving you over these last years, with some of my clients having been with me for over twelve years. I will continue to blog at Barnhardt.biz, which will be subtly re-skinned soon,and will continue my cattle marketing consultation business. I will still be here in the office, answering my phones, with the same phone numbers. Alas, my retirement came a few years earlier than I had anticipated, but there was no possible way to continue given the inevitability of the collapse of the global financial markets, the overthrow of our government, and the resulting collapse in the rule of law.

As for me, I can only echo the words of David:

Rick Santelli was just on CNBC pointing out that there have been no answers forthcoming on the MF Global mess.  There are reports that several people who you would never expect to have gotten caught in something like this did, including Gerald Celente.

The reason they got caught is the same reason I would have gotten caught if I had been clearing through MF Global: Despite being around the markets since well before the 2000 crash and having successfully negotiated that and the 2008 mess everyone has believed, right up until MF blew up, that customer funds were in fact segregated and thus this risk would never occur.

Simply put everyone has now discovered that this assumption is wrong.

Abramoff Sings about Congressional Insider Trading

Love him or hate him, Jack Abramoff is out of jail and singing like a bird about how the political elite “legally” make money off of insider trading, while private citizen’s are run down with pitchforks for the same behavior.  Even if it were proven that a politician made money from insider advice through political legislation, they would not be charged with a crime.  The Stock Act H.R. 4188 was written in January of 2009, by none other than our own Representative Brian Baird (D-WA), and it has yet to come out of committee for a vote.  Now how is this equal justice under the law?  Shelly wonders why  the politically elite are tone deaf to movements like “the Tea Party” and the “Occupiers” who rise-up specifically because of this type of preferential treatment?

Another great story dealing with the same subject will be aired on CBS, Sunday night, November 13, 2011 at 7:00pm ET/PT.  Here's a brief tidbit from the online story that should've been told many decades ago.  It's this type of disparity that keeps the law abiding citizen's from fully engaging in the political process, because we all know that thus far it's a rigged game and the only people who can fix this are the people.  As is said in the article; "Throw them All Out!"  We need moral, principled people in public office representing the "People", not the "Parties"!

Think “Solyndra” is a freak example of “Pay to Play”? Think again!

Looking over emails and news hi-lights, I like to peruse the comments for links to related articles that didn’t make it to the headlines of the mainstream media.  The article posted below I found interesting, and wanted to share with you.  The original article was about the 2012 Continuing Resolution, of which the Republican House has stripped further funding for activities like SolyndraThe comment section contained a link to this article on “Abound Solar”, Colorado’s own Solyndra.

The Republican’s in Congress have cut further energy underwriting with your tax dollars, to offset the additional funds needed for 2012 and FEMA.  Wasn’t the selling point of the agreed upon 2011 CR, that any increased, future spending, was to be offset with an equal dollar in spending cuts?

Be sure to contact your Republican or Democrat, Congressman and/or Senator, to show your support for principled representation in politics, such as the 2012 Congressional version for Continuing Resolution.  The few jobs created for an average cost of $300,000.00 per job in the “green economy’”, isn’t due to it’s environmental superiority, it is due to the number of “Benjamin’s”, it’s bringing to private businesses and public Universities to nudge society ever closer to the brink of economic collapseThe public/private compacts that have contributed to the demise of real free markets, continue to be politically accepted and are a stark example of the public’s tolerance for fiscal malfeasance, in their hopes of getting some of that “free” money.

Counting the Democrat Bodies Involved in a Taxpayer-Guaranteed Loan

By now it’s obvious that the Solyndra scandal never should have happened.  It’s not even a case of Monday morning quarterbacking. A number of people involved could see the disaster coming.

There is a larger principle here. Government should not use taxpayer money to socialize risk while privatizing profits. Examples such as Colorado-based Abound Solar, which received a $400 million loan guarantee, prove that crony capitalism simply rewards the well connected at taxpayer expense.

Abound Solar

Abound Solar, according to its Web site, “produces next-generation thin-film cadmium telluride solar modules” and “is committed to reducing the cost of solar electricity to levels competitive with fossil fuels.”

It is the brainchild of former Colorado State University (CSU)Professor W.S. Sampath and two former students Kurt Barth and Al Enzenroth.  It began as AVA Solar and then incorporated into Abound in 2007.

The Web site says it employs 350 people in three Colorado locations.  Its Colorado manufacturing plant is located in Weld County, which granted Abound up to $100,000 per year for the next ten years in business property tax rebates.  According to sources, the reason for the rebate was job creation intended to benefit Weld County residents. Yet when officials and interested parties ask how many of the 350 jobs have gone to Weld County residents, the solar company does not answer.

Currently Abound has a manufacturing capacity of 65 megawatts expanding to 850 megawatts – at some point. However, in 2010 it manufactured only 30 megawatts. One wonders, if Abound can produce more, why doesn’t it? Click to read full story.

Changing the Conversation

Everyday I asked myself, “How did we get here?  What’s wrong?  Why do they get away with suing the taxpayers from their constitutional rights?”  It was two years ago that I first heard of Agenda 21 and I have understood ever since that time, that this is the answer to my questions.  Well it looks as though I am not a lone voice in the wilderness, because everyday I find more U.S. Citizens like myself who have come to the same conclusion as I.

Agenda 21 is the “cancer” and the only cure for it is to elect principled people into political office at the local/state/federal levels to defund, remove the language, strengthen our constitutions and charters, from Agenda 21. Lastly, we must demand that our elected representatives cancel our membership to a United Nations that would salaciously work to subvert the United States Constitution, state Constitutions and local Charters, outside of our political processes.

It’s A Spending Problem–Not A Taxation Problem

Congressman Allen West, FL, discusses the latest polls which show that Conservatives, Independents and especially those of the Tea Party persuasion want Congress to stick to their promise of deep spending cuts to bring down the deficit, salvage the United States credit worthiness and insure that the nations children and grandchildren will not be burdened with this generations spending problem.

In other words; “It’s time to dance with those who brought you to the dance!”  Compromise shows weakness to the Obama Administration and if you didn’t hear the real Barak Obama in the audio clip that was released on Thursday, then you’re deaf.  Speaker Boehner and the U.S. Congress must stand-up to his “Chicago Thug Tactics” and demand that the U.S. Military are funded.  Just ask “We the People” if we’ll stand for the “Commander in Chief” to deny the troops their wages in a time of war!

Senate Republican “Mike Lee” Defends the Tea Party

After all the dust has settled.  After continuing resolution, after continuing resolution.  After all the fear mongering and mud slinging.  After both the US Congress, US Senate and the Obama Administration are done strutting their stuff for cutting $38bil from a $14tril deficit.  Who should really get the credit?  If not for the “Tea Party” movement, there most likely wouldn’t have been even this miniscule cut in federal spending.  If ever there was a reason for re-stating this years Whatcom County, Tea Party Rally for April 15th of, “We’re Not Going Away”, this last cock and bull of a budget fight was it!

(CNSNews.com) - The U.S. Treasury has released a final statement for the month of March that demonstrates that financial madness has gripped the federal government.

During the month, according to the Treasury, the federal government grossed $194 billion in tax revenue and paid out $65.898 billion in tax refunds (including $62.011 to individuals and $3.887 to businesses) thus netting $128.179 billion in tax revenue for March.

At the same, the Treasury paid out a total of $1.1187 trillion. When the $65.898 billion in tax refunds is deducted from that, the Treasury paid a net of $1.0528 trillion in federal expenses for March.

That $1.0528 trillion in spending for March equaled 8.2 times the $128.179 in net federal tax revenue for the month.

The lion’s share of this federal spending went to redeem Treasury securities that had matured during the month—most of which were short-term Treasury bills that have terms of one-year or less.

In fact, during March the Treasury redeemed $705.3 billion in Treasury securities of which $623.9 billion were short-term bills with a term of one year or less.

After the disbursements made to pay off the $705.3 billion in loans that came due in March, three of the other top four federal spending items for the month were entitlements programs. The other top item was payments to defense contractors.

The Treasury paid $49.8 billion in Social Security benefits in March, $47.4 billion in Medicare benefits, and $22.575 billion in Medicaid benefits. It also paid $37.9 billion to defense contractors.

To help pay off its $1.0528 trillion in monthly bills on only $128.179 in monthly tax revenue, the Treasury turned primarily to new borrowing. During the month, according to the Treasury statement, the government sold $786.5 billion in new securities. It also drew down its cash balance from $190.6 billion at the beginning of the month to $118.1 billion at the end of the month. It also reaped $18 billion from the sale of assets in the Troubled Asset Relief Program.

The federal government’s cash-flow situation was summed up pungently in Senate Budget Committee testimony by Erskine Bowles, who served as chief of staff to President Bill Clinton and is now the co-chair of President Barack Obama’s National Commission on Fiscal Responsibility. (See video below.)

“I'm really concerned,” Bowles told the committee last month. “I think we face the most predictable economic crisis in history. A lot of us sitting in this room didn't see this last crisis as it came upon us. But this one is really easy to see. The fiscal path we are on today is simply not sustainable.

“This debt and these deficits that we are incurring on an annual basis are like a cancer and they are truly going to destroy this country from within unless we have the common sense to do something about it,” said Bowles.

“I used to say that I got into this thing for my grandchildren,” Bowles said. “I have eight grandchildren under five years old. I'll have one more in a week. And my life is wonderful and it is wild. But this problem is going to happen long before my grandchildren grow up.

“Head of Congressional Appropriations Get It”

Congressman Dennis Rehberg, has released a letter to his Montanan constituents that tells it straight to his State Voters.  For those of you who do not know who Congressman Rehberg is, he is the recently appointed head of the Congressional Appropriations Committee.  In other words, he’s chairing the spending proposals that have come out of Washington D.C. since the House change in January of 2011.  Please take the time to send the Congressman an email, a letter, a phone call, a Facebook post, to show your support or disagreement, with the direction of the “2011 U.S. Congressional Appropriations” efforts to reduce federal spending to “sustainable” levels.

Rehberg Opinion: The Middle Ground Between Collapse and Shutdown: Spending Less

Why are Montanans being told that they have only two choices: More government and record-deficits, or a complete government shutdown.  The Montanans I’ve talked to at 77 listening sessions offer the third common-sense choice:  The federal government can spend less.
And we’ve got to because our overspending is strangling economic recovery and destroying jobs.  It’s putting the American Dream out of reach for our children and grandchildren.  We face great challenges, but this is still America.  We will overcome those challenges.
It’s a 704 mile drive across Montana on I-90 and I-94.  Imagine those miles represented our national debt of $14,238,130,000,000.  Each mile on the way is $20.2 billion borrowed from our children and grandchildren.  Every foot across our state is $3.8 million of debt.
From the birth of our country through January 2007, the total federal deficit was about $8.6 trillion.  On our road trip, this gets us from Lookout Pass on the Idaho border to about 20 miles west of Billings at a leisurely pace of about 2 miles per year.  This part of the journey spans the Revolutionary War, the Civil War, the Great Depression, two World Wars, the Cold War, 9/11, Hurricane Katrina and everything in between.
In January 2007, Harry Reid and Nancy Pelosi took the wheel with new majorities and a lead foot.  They cranked the big-government throttle and our deficit accelerated from 2 miles a year to a mind-boggling 69 miles a year.  With them at the wheel, we completed the second half of the trip through Billings all the way to North Dakota in just four short years.  They nearly double our national debt.
The American taxpayer has been taken for a ride with their own money and in November, they told Washington to hit the brakes.  But for some in Washington, that’s just not an option, they want to set the cruise control instead – freezing spending at the very highest levels of the last four years.
