Score “One” for the Constitution v. Executive Office Abusers

Some of the best news I’ve read in a long time.  There is still some sanity in our courts and an understanding that the U.S. Constitution set-up a separation of powers intentionally to protect you and I from government tyranny.

The Landmark Legal Foundation (aka Mark Levin) has done our Country a great service by forcing this issue into the courts and setting the precedent that Presidents and their Executive Branch must follow the laws of the Constitution.

Enjoy the article and don’t forget to send your thanks to the Landmark Legal Foundation for taking this issue to court.

Obama recess appointments unconstitutional

In a case freighted with major constitutional implications, a federal appeals court on Friday overturned President Obama’s controversial recess appointments from last year, ruling he abused his powers and acted when the Senate was not actually in a recess.

The three-judge panel’s ruling is a major blow to Mr. Obama. The judges ruled that the appointments he made to the National Labor Relations Board are illegal, and hence the five-person board did not have a quorum to operate.

But the ruling has even broader constitutional significance, with the judges arguing that the president’s recess appointment powers don’t apply to “intra-session” appointments — those made when Congress has left town for a few days or weeks. They said Mr. Obama erred when he said he could claim the power to determine when he could make appointments.

“Allowing the president to define the scope of his own appointments power would eviscerate the Constitution’s separation of powers,” the judges said in their opinion.

The judges said presidents’ recess powers only apply after Congress has adjourned a session permanently, which in modern times usually means only at the end of a year. If the ruling withstands Supreme Court scrutiny, it would dramatically constrain presidents in the future

  • Of course the NLRB feels very confident that President Obama’s appointments will be upheld; so why adhere to a pesky verdict from an insignificant decision that goes against them?  They have important work to do and until someone forcibly stops them, they’re going to continue on as if nothing has changed.  Wonder if AG Holder’s office will step-in and uphold the federal courts ruling?

Obama’s Union-Controlled NLRB Thumbs Nose At Court Ruling, Chairman Vows To March Onward

    NLRB picketing

Following Friday morning’s appeals court ruling that Barack Obama’s “recess” appointments to the National Labor Relations Board were unconstitutional, union attorney (and current NLRB chairman) Mark Gaston Pearce vowed to ignore the court’s ruling.

In a statement posted on the NLRB’s website, Pearce stated:

“The Board respectfully disagrees with today’s decision and believes that the President’s position in the matter will ultimately be upheld. It should be noted that this order applies to only one specific case, Noel Canning, and that similar questions have been raised in more than a dozen cases pending in other courts of appeals.

Buffett Profits from Keystone Pipeline Shut-Out

When oil platforms were turned out of the Gulf of Mexico, the Obama Administration was quick to seek favor with the country of Brazil ($5bil of favor) to import crude oil to the United States.  Of course that didn’t happen, because the Brazilian’s took our $5bil and then contracted with the Chinese to refine their crude oil.

Now that the Obama Administration has sided with the EPA and asked to leave the Keystone pipeline decision for after the 2012 elections, it has been ascertained that one person is positioned to potentially profit from this decision.  Warren Buffett.  Buffett’s empire has been buying into “railroads” and if the Canadian’s don’t get too peeved off at the US for shutting down the pipeline, they could likely sign-on with Buffett’s railroad to transport their oil for refining in the US or Mexico.  It would be a much more expensive venture for the Canadian’s, than a pipeline (over the long term) would be, but it is do-able. Or, the Canadian’s could choose to build a pipeline westward in Canada and export the crude oil to China.  China is knocking on Canada’s door to sign a “long term” contract with them to purchase Canadian oil for refining in China.

Only time will tell, but the big losers here are all of the jobs the creation of the Keystone pipeline would create, the immediate economic boost from energy stability for the US and the greatest benefit of all is that we retain and improve our bonds with Canada.

Time will tell and I, for one, pray that the pipeline issue continues to be made by those who understand the great benefit to the people of the United States.

Buffett would profit from Keystone cancellation

    By Dave Boyer

    The Washington Times

    Tuesday, January 24, 2012 ~ Warren BuffettBuffett

Warren Buffett, whom President Obama likes to cite as a fair-minded billionaire while arguing for higher taxes on the wealthy, stands to benefit from the president’s decision to reject the Keystone XL oil pipeline permit.

Mr. Buffett’s Berkshire Hathaway Inc. owns Burlington Northern Santa Fe LLC, which is among the railroads that would transport oil produced in western Canada if the pipeline isn’t built.

“Whatever people bring to us, we’re ready to haul,” Krista York-Wooley, a spokeswoman for Burlington Northern, a unit of Buffett’s Omaha, Neb.-based Berkshire Hathaway Inc., told Bloomberg News. If Keystone XL “doesn’t happen, we’re here to haul,” she said.

    The “Occupation” Party

So we’ve gone from “Occupy Wall Street”, to the “Flea Party”, to “Pigs at the Trough” and now another fitting descriptive label “The Occupation Party”.  If that doesn’t speak of Marxist ideology, well you must have slept through every class during your public education.Sus Devp (small)

Shepard Fairey, L.A. Street Artist, Designs Party Invite for Occupy Wall Street

By Simone Wilson Fri., Oct. 14 2011 at 10:45 AM Categories: Arts News, Occupy L.A.

    OWS Invite shepard fairey.jpg

A West Coast legend does his part.

Yup. This just happened. Right after receiving the victorious news from New York Mayor Michael Bloomberg that Occupy Wall Street doesn't have to move out of Zuccotti Park after all, protest organizers learned they'd been blessed with a Shepard Fairey original.

An East Coast art-blog editor who's been keeping up with the artistic aspects of OWS (and oh, there are many -- in L.A. too!) told WNYC radio of Fairey's "Occupation Party" invite: "I think it's really great that it's an upward looking positive image, as well as it tries to tie together a little bit of the radicalism of the 60's with today."

    obama_hope.jpg

    Look familiar?

Indeed -- Fairey's apparently still on his strong-black-person-gazing-majestically-into-the-heavens kick. But will his (very kind) contributions to the movement revive the Obama "Hope" curse?

Fairey's portrait of the president lured millions of huddled hipsters to the voting booths in 2008. But after many of them decided he's just as useless as the next paid-off politician -- seeing as, you know, the sky didn't rain down free pot and iPads -- the "Hope" symbol took on a new cheesy patriotism.  Click here for the full story.

If you are going to tell the truth, tell the whole truth. This has been a 3 ring circus from jump street. The problem is, it's using people's anger or envy over 100 different issues, and when the only uniting factor is anger, being fueled by global reformists that are not part of or care about the American way of life, you are creating a brew that is not good for the 99%, not good for civilization. If you get your 100 wishes, the economy will be worse, entitlements will be unsustainable, blood will run in the streets, and the system that has done more for the quality of life of millions around the globe will be weakened.

    What Now Whatcom County?

Primary Election 2011 results are in and the November 2011 General Election is just around the corner.  Will the voters take the time to research and question the candidates?  Or, will they vote for the candidate they deem to be the popular choice based on warm, fuzzy words of encouragement and postcards that show them to be stalwart members of the community with an attractive family tree?

There is a strong, prescient need for the former, not the latter to happen in the upcoming election.  Whatcom County is truly at a crossroad to decide if they will continue on the path of costly, burdensome regulatory suffocation caused by, “Sustainable Development”, or return to a proven economic driver for private business, “Free Market Capitalism".  The free markets that I refer to here are not what we have experienced for the past 2 decades, where government has micromanaged private business and caused them to become dependent upon government handouts.

The fastest growing pseudo-private businesses have learned how to bend the votes of local governments for public/private partnerships.  The local governments have learned how to get state, federal, corporate and  international dollars thru NGO’s, outside of the political process and these NGO’s come under the charter of the United Nations to receive their endorsements.  With these endorsements the NGO’s have the “carrot and stick” to attract government and private business with favorable lending rates to achieve the goals of “Agenda 21”.  The big requirement asked of government(s) is to write into local/state/federal legislation the language from “Agenda 21”.  Private business is required to accept and operate their business under the apex (top down) structure of “Agenda 21”.  The NGO’s write the language which your local government legislates into local ordinances with the mindset that the language will withstand 3rd party lawsuits from private citizen’s and businesses.  Once this language has been approved, the NGO’s have the ability to use our tax dollars to sue us in our courts and win.

The big problem with “Agenda 21” (in my personal opinion and that of many others) is that it is the driver to place “Socialism” on to a global platform.  Agenda 21 is a grandiose scheme to re-distribute the wealth of nations and private business to give “social justice” to 3rd world nations and their impoverished citizens.  Agenda 21 does not address the political structures of tyrannical dictatorships. In fact, Agenda 21 does pave the path of an assured two class social system; the elites and the working-class poor.  I say this with confidence because within the language and goals of Agenda 21 are the words of Maurice Strong from the Earth Summit of 1992; “It is clear that current lifestyles and consumption patterns of the affluent middle class -- involving high meat intake, consumption of large amounts of frozen and convenience foods, use of fossil fuels, appliances, home and work-place air-conditioning, and suburban housing -- are not sustainable.” (This quote is linked to a short video from 1972 where Maurice Strong speaks about his beginning efforts to work for the de-industrialization of industrialized nations because they believed then as they do now that our lifestyles are unsustainable…”Well Mr. Strong, you’ve come a long way baby!”)

For anyone who has read the works of Friedrich Hayek, you already know that his study of socialism showed that all socialism will eventually lead back to nationalism, because it always fails to address the needs and wants of the very people it is dependent upon to support it.  The known leaders of socialistic governing structures have all devolved into tyrannical elites and some have facilitated the murder of their own citizen’s because they dared to resist the tyranny and in-humane treatment of people.  The most important finding of Hayek’s studies is that socialism will always fail, unless it were to be globalized.  After all where will the people run to if socialism is achieved on a global scale?

So again I say, “What now Whatcom County?”  It is up to We the People to become informed voters who will ask tough questions of those who seek to be our representatives.  The power truly lies within our local governments and we have the ability to hold them accountable to us.  Any valid candidate must know and understand what Agenda 21 is, be able to tell the voter whether they do or don’t support the goals of Agenda 21, and do they understand that the fastest way back to economic health is to remove the local government from the chains of Agenda 21?

The key is that they will must be willing to walk away from state and/or federal money that comes with strings attached to the goals of Agenda 21. You say you don’t know what Agenda 21 is?  Well it is incumbent upon you to get to know Agenda 21, and I have provided a link to Tom DeWeese’s, “Agenda 21 In One Easy Lesson”, to start your journey.

“Houston! We Still Have A Problem”

The reason that states like Wisconsin have approved the removal of collective bargaining for ‘public’ employees is expressly explained by the following links.  Please take the time to go to these sites and read the full story.  My spouse has a small union pension which we started collecting on 3 years ago.  1 1/2 years ago I received a letter stating that the pension fund was at 65% funding (stage yellow).  One year later I received a letter stating that the pension fund level was still headed downwards and they had one more year to bring up the funding level or reduce all pensioner's reimbursement by 35% or greater, in order to remain compliant with the law (s).  Last week I received a letter and I am going to copy the language  from the letter “verbatim”.  Please take the time to read and absorb what this information means to “all” private citizen’s and tax payers, after which I ask you to follow this link to the labor dispute (of which there are many) happening in Orange, CT, between Teamsters Local 443 and Dichello Distributors.

The purpose of this notice is to advise you that the Board of Trustees of the ***** **** Retirement Plan (“Plan”) elected to take advantage of certain special funding rules available under the Preservation of Access to Care for Medicare Beneficiaries and Pension Relief Act of 2010 (Pension Relief Act of 2010).  These rules were put in place by the Federal government to help multiemployer pension plans respond to the historic investment losses suffered in 2008 and 2009.

No Changes are being made to your current benefits or the rate at which you earn future benefits under the Plan.

Explanation of special funding rules elected by the Trustees

Each year the Plan’s actuary prepares a valuation that compares the Plan’s liabilities (essentially benefit promises to current and future retirees and beneficiaries) to the actuarial value of the Plan’s investments.  The market value of investments fluctuates from day to day.  For funding purposes, Federal pension law allows plans to use actuarial values of plan investments that are designed to smooth out those fluctuations.

The Trustees have made elections permitted under Federal law related to the investment losses incurred during the 2008-09 year.

    Elections Made

Extended amortization of investment losses.  Federal law generally requires that investment losses be taken into account for funding purposes over a 15-year period.  By electing to use this rule, the Plan’s net investment losses incurred in the 2009-09 plan year will be taken into account for funding purposes over a 29-year period beginning after the end of the plan year in which the loss was incurred.

Expanded asset smoothing.  Federal law allows the Plan to “smooth” out variations in the market value of investments by spreading the difference between the expected return on Plan assets and actual return over a five-year period.  By electing to use this rule, the difference between actual investment returns and expected investment returns for the plan year ending June 30, 2009 will be spread over ten years instead of five.

Effect of the application of the special funding rules

In general, applying the special funding rules allows the Plan more time to recover from the investment losses in 2008-09 while maintaining the current level of benefits provided under the Plan.  The special funding rules will reduce the level of annual contributions needed to meet minimum contribution requirements under the law.  The special funding rules may also improve the Plan’s zone status in future plan years.  You will continue to receive annual funding notices that give you information about the Plan’s funding status.

Future benefit improvements limited by special funding rules

Under the Federal law, the Plan cannot generally improve benefits while the special funding rules apply and during the two-plan year period thereafter (“Restriction Period”).  An exception is provided if the amendment is required as a condition of continued qualification under the Internal Revenue Code, or the Plan’s actuary certifies that (i) the increase is paid for by additional contributions and (ii) the benefit  (and associated contribution) increase is not reasonably expected to reduce the plan’s funded percentages and credit balances during the Restricted Period.

As a result of the elections described above, the Trustees currently anticipate that benefit improvements will be limited until June 30, 2017.

Washington State Unions Plan Week of Protests for No Wage or Benefit Cuts

Not all Union members are happy that their precious union dues are spent this way. How else do you think I received this email being shared among the local unions?

For some insane reason the Unions don’t understand how the financial and benefit packages that they procured during ‘collective bargaining’ is one large part of what’s destroying the private sector. Wake up! If there’s not a growing private sector and private sector jobs, there is no money to pay for public services.
Legacy and benefit plans are unsustainable for the obvious reason that they are not only ‘too’ generous, but also because the public sector has grown faster than the private sector and has not adjusted itself in the tough times as the private sector does. The private sector adjusts itself naturally due to market forces. The public sector does not adjust itself naturally due to the choke hold they have on the public coffers. Politicians who were more concerned about getting public union dollars for their elections, than looking out for the best interest of all the tax paying citizen’s they represent, have sold both sides a lemon.

So, Washington State Unions, protest all you want…that does not change the truth.

My Friends, it's time to take a stand!

As the budget shortfall continues to grow, so do the attacks on public employees and Washington families. Legislators are scapegoating workers while giving away billions in tax breaks to out of state corporations.

Did you know state Senator Zarelli is fighting to reject your contract because he thinks the 3% pay cut you agreed to isn't enough (SB 5870)? Or that he wants to create a PERS 4 retirement system that will eliminate your guarantee pension (SB 5908)?

It doesn't matter that your sacrifices will save the state more than $330 million or that you've sacrificed more than $1.5 billion in the past 2 years. It doesn't matter that these bills won't save the state money and that they'll actually hurt our recovering economy.

They want to bust the Unions.

It's time to take a stand in Olympia! Join me and the thousands of other union members from across the state on Friday, April 8. [learn more here]

Let's send a message to law makers that the workers didn't cause this budget crisis and they can't solve the problem on our backs.

Buses are filling up fast! Please email me back and let me know what bus you're planning to ride or if you're planning to get here on your own.

Rally at the Capitol steps at noon on April 8 to demand that legislators put people first when seeking solutions to the budget crisis.
Washington state's economy has been brought to its knees over the past several years - not by working men and women, but by Wall Street bankers who created the worst economic crisis in our country since the 1930's. Many ordinary working-class people have already paid the price in lost jobs, homes, services and hope.
People are looking for real solutions. We don't need more cuts to working families. We need legislators to recognize that public servants and middle-class workers have already made deep sacrifices to help fix the economy.
The legislature gave away $3 billion in tax breaks in the past 10 years. We need legislators to close tax loopholes and protect the safety net.

On April 8th - come to Olympia and stand in solidarity to demand that legislators protect the middle class and find real solutions to the budget deficit.

One Audio Tape is Worth a Thousand Words

“Breaking News!” There’s not much to say when the audio says it all.  There are many covert groups (public employees) who are actively working to destroy; capitalism, the U.S. Constitution, private property rights, liberty and freedom.  When they are asked about their actions they always use these words; “collective, shared, village, community, equitable distribution, qualitative not quantitative results”, to sell their agenda.  As Hayek found in his study of socialism/communism/progressivism/statism/marxism/, they all lead to tyranny.  Tyranny is best described as a select group of elitist who decide what is best for the collective good.  Go back and watch the movie “1984”, where one size fits all is the mantra.  Wouldn’t that kind of be like living in a Wal-Mart world?

(As an added aside I had to re-post this and ask if anyone else has connected the dots between this revelation and the interview of Michael Moore on Rachel Maddow’s program.  During the Madison, WI. protest with regards to the State Legislature vote to remove collectively bargaining for public employees, Michael Moore flew to Madison, WI, to show his support for and rile up the masses to take over and shut down the Wisconsin State House.  Then, on Ms. Maddow’s program, Michael Moore showed off a pair of handcuffs, swinging them in front of the camera while he ranted about how they were coming for Wall Street and the Bankers.  Mr. Moore continued his rant and finished that they wouldn’t stop until the money was returned to the people and the Bankers were in jail.  Common sense tells me that these events ‘are’ connected.)

    UNIONS THREATEN BUSINESS

That's a nice business you got there. Pity if anything were to happen to it if, say, you didn't toe the line and denounce Governor Walker like we're asking nice-like.

    Mr. Tom Ellis, President

    Marshall & Ilsley Corporation

    770 N. Water Street

    Milwaukee, WI 53202

SENT VIA FASCIMILE AND REGULAR MAIL

    Dear Mr. Ellis:

As you undoubtedly know, Governor Walker recently proposed a “budget adjustment bill” to eviscerate public employees’ right to collectively bargain in Wisconsin. ..

As you also know, Scott Walker did not campaign on this issue when he ran for office. If he had, we are confident that you would not be listed among his largest contributors. As such, we are contacting you now to request your support.

The undersigned groups would like your company to publicly oppose Governor Walker’s efforts to virtually eliminate collective bargaining for public employees in Wisconsin. While we appreciate that you may need some time to consider this request, we ask for your response by March 17. In the event that you do not respond to this request by that date, we will assume that you stand with Governor Walker and against the teachers, nurses, police officers, fire fighters, and other dedicated public employees who serve our communities.

In the event that you cannot support this effort to save collective bargaining, please be advised that the undersigned will publicly and formally boycott the goods and services provided by your company. However, if you join us, we will do everything in our power to publicly celebrate your partnership in the fight to preserve the right of public employees to be heard at the bargaining table.

Wisconsin’s public employee unions serve to protect and promote equality and fairness in the workplace. We hope you will stand with us and publicly share that ideal.

In the event you would like to discuss this matter further, please contact the executive Director of the Wisconsin Professional Police Association, Jim Palmer, at 608.273.3840. Thank you in advance for your consideration.

In January of 2008, our President, Barack Obama, led a rally of SEIU supporters to paint the nation Purple (SEIU colors).  Do you think that the President of the United States, Barack Obama, the leader of ‘all’ the citizens of the United States, should be meeting with labor organizers twice a week, have daily phone contact with labor organizers all in support of painting the nation purple?

Well if you’re uncomfortable with the cozy relationship between politics and labor unions, this is the place for you to voice your concern.  If you are concerned about the unending favors to one sector of society to the demise of another, this is the place for you to voice your concern.  If you are concerned about saving the U.S. Constitution as a guardian for “equal” justice over “social” justice, this is the place for you to voice your concern.  Of course I know that as true patriots to the Country and Constitution, that you will bring honorable representation of that to the rally!
